The European Court of Human Rights (ECHR) considers that the expulsion of illegal migrants from Europe is not lawful. On Tuesday, l'Economiste reported that the court after having ruled on the case of a Malian and an Ivorian migrant who had crossed the fences of Melilla on August the 13th, 2014, before being immediately sent back to Nador and then Fez, along with 75 to 80 other migrants. For the ECHR, «no State is allowed to return migrants to their country of origin without first carrying out certain administrative and judicial procedures (identification, assistance by a lawyer ...)». The court also considers that Madrid has not complied with the European Convention on Human Rights. Accordingly, the expulsion of the two Malian and Ivorian nationals «constitutes a violation of the above-mentioned convention». Spain, as a result, will have to «pay 5,000 Euros to each of the two migrants for 'non-pecuniary damage,» the same source concludes.
